Relevant supportive technical experience encompasses experience in environmental engineering and construction. SKILLS AND ACCOMPLISHMENTS

Legal Advocacy

 

Performed legal and technical assignments related to environmental, intellectual property and business law. Highlights of recent activities include: 

  • Participated in the defense of two federal environmental lawsuits, one brought under the Clean Water Act, citizen suit provision, by political action groups against the New York Athletic Club in the Second Circuit of New York; the other in the state of Connecticut against Remington Corporation for RCRA violations, also under the Federal citizen suit provision. Participated in several trials regarding land use management and environmental cost recovery.

 

 

  • Prepared numerous comments and participated in various association coalitions for regulatory administrative rulemakings by the U.S. Environmental Protection Agency and the Department of Labor on the topics of: Hazardous Waste Incinerator Emission Limitations, Clean Air Act Title III Hazardous Air Pollutants, Ozone and Dioxin Emissions, Hazardous Waste Exemption under the Bevill Amendment for Cement Kiln Dust; revisions to the Clean Water Act Discharge Limitations; and Ergonomic Repetitive Motion Injuries. Other CERCLA and RCRA issues included munitions waste for rifle ranges and military installations.

 

 

  • Counseled clients in all phases of environmental law, including clean air, clean water, hazardous waste, RCRA corrective action, CERCLA and remediation cost recovery. Participated in the EPA regulatory roundtable discussions on the revisions to the TSCA lead toxicity standard. Prepared lead standard exposure documents for the National Rifle Association.

 

 

  • Acted as the association representative to the U.S. Environmental Protection Agency for the Portland Cement industry in negotiation of the Title III of the Clean Air Act of 1990 standard for hazardous air pollutants, Title V Permit Applications, and Title IV NOx reduction. Responsibilities included testifying before the Ozone Transport Commission and other regulatory bodies regarding interstate transportation of pollution and NOx reduction as well as negotiation with the USEPA, Air Branch, in Research Triangle Park, North Carolina.

 

  • Represented large commercial client in TSCA PCB violation administrative hearing. Reduced potential liability by 40 percent.

 

 

  • Prepared Section 104(e) response and successfully defended automotive supplier from potential liability under CERCLA.

 

 

  • Counseled a large municipal utility regarding violations of the Lead and Copper Rule pursuant to the Safe Drinking Water Act including compliance, remedial action and representation before the USEPA.

 

 

Consulting

 

 

Served in project management and consultant capacity for clients in nuclear and fossil power plant and water and wastewater treatment plant design; hazardous and mixed waste evaluation and treatment, including remedial investigation/feasibility studies, remediation and waste minimization; and hazardous material evaluation, including material safety data sheet preparation, personnel training and hazard labeling. Prepared extensive state and federal regulatory interpretations, performed facility audits and supervised implementation of corporate procedures for maintaining compliance with federal (RCRA, CERCLA, SARA, TSCA, NEPA, CWA, CAA, FIFRA, OSHA, and 10 CFR 20 & 50) and state regulations for Ohio, Michigan, Illinois, Indiana, Iowa, and Florida. Conducted investigations and prepared emergency planning documents as required by SARA Sections 311, 312, 313, and NUREG 0654.

Project Management

Performed project management duties on various projects including power, water and wastewater treatment and general industrial construction. Duties included manpower allocation, scheduling, cost control and cash flow analysis (baseline costing), strategic planning, risk management, acquisition management, project execution plans, change control and earned value management. Other duties included value engineering, and estimating and supervising engineering detailing for civil, mechanical, and electrical disciplines.

 

 

Performed construction management duties on projects, including conceptual estimating, bid package preparation, bid procurement and evaluation. Project Size: $1 to $750 million, performed startup services on all projects.

 

 

Field Engineering

 

 

Served in a field engineering capacity for different types of environmental activities, including water and wastewater treatment plant optimization, chemical polymer evaluations and process mechanical equipment erection and startup. Other activities included air pollution testing for particular matter, SO2 and NOX as required by EPA Methods and ASME Test Codes, water sampling by composite analysis and other methods, and sewer infiltration studies performed by dye analysis. USEPA-contracted studies were performed for various types of petrochemical facilities to determine total pollution loads (air, water and solid waste) by material balance calculations for preliminary process design and federal environmental regulation promulgation.
